National Fitness Institute, Inc. | 752 A.2d 631 (2000)  Liability waivers are common in the fitness industry, where customers engage in physical activities and run the risk of injures. In Seigneur versus National Fitness Institute, Incorporated, a woman who embarked on a journey to improve her physical fitness soon regretted signing a membership contract that released her gym from liability for any injuries.  When Gerilynne Seigneur decided to start a new fitness regimen, she purchased a one-month trial membership at a gym owned by National Fitness Institute, or NFI. Seigneur chose the gym based on her chiropractor’s recommendation and the gym’s ads, which stated that it employed certified fitness and health specialists and promised to provide programs appropriate for customers’ health and fitness status based on scientific evidence. During the sign-up process, Seigneur disclosed that she had a history of serious back problems and that her physical fitness was poor. She also signed the gym’s membership contract acknowledging that exercises at the gym were at her own risk. The contract also included an exculpatory clause that released NFI from liability for any injuries. During an initial evaluation where she performed various flexibility and strength exercises at the instruction of a gym employee, Seigneur seriously injured her shoulder and required surgery.  Seigneur sued NFI for negligence and claimed that the contract was unclear and ambiguous and that the exculpatory clause was against public policy. The trial court granted NFI’s motion for summary judgment, and Seigneur appealed to the Maryland Court of Special Appeals.   Want more details on this case?
